  1. Whenever you find a debt collector violating the laws, you should file a complaint with the Federal Trade Commission which enforces the FDCPA. But the FTC will not go after the debt collector on the basis of your complaint alone. Numerous complaints against the revenue agent working for the same company may equal a lawsuit against the company. You can register your complaint by calling or writing to the FTC at Federal Trade Commission, Consumer Response Centre, 600 Pennsylvania Avenue, NW, Washington, DC 20580. You can even file a complaint online.
  2. File a complaint against the debt representative to your state attorney general’s law, if your state has a law that applies to debt collectors. Though your attorney general’s office won’t sue a debt collector on your complaint alone, it may help the office build a legal case against a debt collection company.
  3. If possible try and see if you can get the illegal behaviour of the debt collector on tape. In many states recording is permitted without the collector’s knowledge. Make sure to include the date and time of the conversation and person you are speaking to. Taped conversation, threatening letters, or any communication whatsoever about the debt collector can be extremely valuable in reconstructing the collection efforts and any abuse. Get a brief statement from any witness in their own words, who can corroborate that you were abused.
  4. If you find a debt collector violating your federal or state legal rights, consult a consumer law attorney. The attorney may ask you to send a notice to the debt collector that if the behaviour continues, you will file a lawsuit.
